Acceptance of Terms
By creating an account or using ClaimDraft, you agree to these Terms of Service. If you do not agree, do not use the service.
Description of Service — Read This Carefully
ClaimDraft is a documentation drafting tool. It helps restoration contractors generate professional written correspondence requesting reconsideration of disputed scope items, using industry standards, Xactimate justification, and documented site conditions as the basis for each letter.
ClaimDraft IS:
- A writing and documentation assistance tool
- A tool for organizing and presenting scope justification
- A productivity tool that saves time drafting professional correspondence
ClaimDraft IS NOT:
- A public adjusting service
- An insurance claim advocacy service
- A legal advice service
- A coverage determination service
- A substitute for a licensed public adjuster or attorney
- A tool for interpreting insurance policy language
ClaimDraft does not determine what your insurance policy covers. ClaimDraft does not interpret policy provisions, exclusions, or coverage terms. ClaimDraft does not negotiate insurance claims on your behalf. ClaimDraft does not act as your advocate in the insurance claims process.
You are the contractor. You perform the work. You document the damage. ClaimDraft helps you write about it professionally.
Contractor Responsibility and UPPA Acknowledgment
By using ClaimDraft, you represent and warrant that:
- a) You are using ClaimDraft to document and justify your own contracted scope of work on properties where you have been engaged to provide restoration services.
- b) You understand that insurance claim advocacy, claim negotiation, and policy interpretation on behalf of a policyholder requires a licensed public adjuster or attorney in most states, and that contractors are generally prohibited from performing these activities.
- c) You will NOT use ClaimDraft to draft correspondence that interprets insurance policy language, argues coverage positions, or advocates for insurance settlement amounts beyond your documented scope of work.
- d) You will review all ClaimDraft output before sending it and take full responsibility for the content of any correspondence you send.
- e) You understand that regulations regarding contractor communications with insurance carriers vary by state and you are responsible for compliance with the laws of the state where you are performing work.
- f) If you are unsure whether a particular communication crosses into public adjusting or legal practice in your state, you will consult a licensed public adjuster or attorney before sending it.
- g) You are NOT using ClaimDraft to perform public adjusting services, act as a public adjuster, or provide services that require an insurance adjuster license.
No Professional Services
ClaimDraft does not provide legal advice, public adjusting services, insurance advice, or financial advice. Nothing generated by ClaimDraft should be construed as legal advice or as a legal opinion regarding insurance coverage.
The output of ClaimDraft is a draft document. You must review it for accuracy, appropriateness, and compliance with applicable law before using it. Empowered Solutions Ltd is not responsible for the consequences of sending any correspondence generated by ClaimDraft.
Data and Privacy
By using ClaimDraft you acknowledge that:
- a) Documents you upload (denial letters, scope documents) are transmitted to Anthropic's Claude API for AI processing. Anthropic does not use API inputs for model training. Anthropic's privacy policy is available at anthropic.com/privacy.
- b) Anonymized, PII-stripped data from your submissions (carrier name, state, claim type, denial category, outcome) may contribute to ClaimDraft's carrier intelligence network if you provide consent at submission. You may opt out in Settings.
- c) Your uploaded documents are stored in private, encrypted cloud storage accessible only to your account. See our Privacy Policy.
- d) You acknowledge that the documents you upload may contain Nonpublic Personal Information (NPI) of policyholders. You represent that you have authorization to process and upload these documents in connection with your restoration services.
Information Security
Empowered Solutions Ltd implements and maintains reasonable administrative, technical, and physical safeguards to protect user data, including:
- Encrypted data transmission (TLS)
- Private cloud storage with access controls (Supabase Row Level Security)
- Authentication required for all account access
- Anonymization of intelligence layer data prior to aggregation
- No sharing of user data with third parties except as required to provide the service (Anthropic API for letter generation, Stripe for payment processing)
We do not sell your data. We do not use your data for advertising.
Limitation of Liability
To the maximum extent permitted by applicable law, Empowered Solutions Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of ClaimDraft, including but not limited to:
- Any claim outcome, whether favorable or unfavorable
- Any regulatory action arising from correspondence you send
- Any inaccuracy in AI-generated output that you relied upon without independent review
- Any violation of state UPPA laws arising from your use of the service
Your sole remedy for dissatisfaction with the service is to stop using it.
Empowered Solutions Ltd's total liability to you for any cause of action shall not exceed the amount you paid for the service in the three months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Empowered Solutions Ltd and its founder, officers, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:
- a) Your use of ClaimDraft in violation of these Terms
- b) Your violation of any applicable law, including UPPA statutes
- c) Any correspondence you send based on ClaimDraft output
- d) Any misrepresentation you make regarding your authorization to upload documents
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Maryland. Any dispute arising from these Terms or your use of ClaimDraft shall be resolved by binding arbitration in Charles County, Maryland, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
Changes to Terms
We may update these Terms. Material changes will be communicated via email. Continued use after notice constitutes acceptance.
